David L. Black is a partner in the Firm’s Malvern, Pennsylvania office. David’s practice involves the representation of clients in commercial litigation. David has represented clients in both state and federal courts, as well as before governmental agencies and in alternative dispute resolution forums. He has experience in all aspects of litigation and has both prosecuted and defended claims from inception through trial. David also handles post-judgment execution proceedings to convert courtroom success into economic recovery for his clients.
Throughout his career, David has regularly handled high profile cases which generate media attention. A few of David’s significant results for clients include obtaining judgment on the pleadings in favor of a client in a dispute over a $20 million condominium sale brought under the Uniform Condominium Act, obtaining the dismissal of due process claims brought against a local animal rights non-profit, and defeating attempts to remove Trustees and leadership from a private educational institution.
For labor and employment clients, David has enforced restrictive covenants, defended against discrimination claims and provided representation for claims brought under the Pennsylvania Wage Payment and Collection Law.
David also represents both residential and commercial landlords in all matters relating to asset management, including tenant disputes and evictions. As part of his landlord and tenant practice, David has extensive experience in counseling clients in all aspects of the management, operation, and closure of manufactured home communities. David also counsels clients on the requirements of Pennsylvania’s Manufactured Home Community Rights Act and routinely handles litigation brought under that Act.
David is currently the Chairman of the Thornbury Township Planning Commission. David enjoys spending time with his family (and can usually be found on a sports sideline or at an equestrian event with his children), playing soccer, and golfing.
- Obtained judgment on the pleadings in favor of a client in a dispute over a $20 million condominium sale brought under the Uniform Condominium Act;
- Obtained injunction prohibiting pro se plaintiff from initiating litigation or otherwise challenging a client’s real and personal property interests, as well as an award of attorneys’ fees against the pro se plaintiff for serial and improper pursuit of litigation;
- Defeated injunction seeking the removal of a private educational institution’s trustees and leadership and ultimately obtained the dismissal of the litigation.
- Representation of clients in real estate disputes, including claims brought pursuant to Pennsylvania Unfair Trade Practices and Consumer Protection Law
- Representation of non-profit fire companies and animal rights organizations
- Representation of national and local developers in litigation against municipal authorities before both federal and state courts
